Terms of service
These terms govern your use of virtualcmo.ai and the VirtualCmo software (the service), provided by the administrator of the virtualcmo.ai service. By running the demo, creating an account or buying a subscription you accept them. Questions go to [email protected].
The service
VirtualCmo is an AI chief marketing officer. It turns a revenue target into a marketing strategy, a budget split and a plan, makes recommendations, briefs AI agents and reports on progress. Recommendations are decision support. You decide which ones to approve, and you set the guardrails for any action the service takes automatically.
The free demo
Anyone may run one demo plan per day without an account. The demo shows part of a plan; the full plan, data connections, agents and reports are part of the paid plans. We may limit the demo to prevent automated or abusive use.
Accounts
You need a valid email address, confirmed with a code, to create an account. You are responsible for the people you invite to your workspace and for keeping sign-in details secure. You must be at least 18 years old and act on behalf of a business.
Subscriptions and billing
- Paid plans are subscriptions billed monthly or yearly in advance, in US dollars, at the prices shown on the pricing page at checkout. Taxes are added where they apply.
- Subscriptions renew automatically at the end of each period until cancelled.
- Moving to a higher plan or from monthly to yearly billing takes effect after the difference for the current period is paid. Moving to a lower plan takes effect right away, and the unused part of your current plan is credited to your next invoice.
- Plan limits, such as recommendations and agent tasks per month, are counted as usage in the billing period. Deleting an item does not return quota. Limits reset at the start of each period.
- One workspace has one active subscription at a time.
Cancellation
You can cancel at any time in the billing portal inside the app. Cancellation stops the next renewal. You keep access until the end of the period you already paid for, and that period is not refunded, except where the law gives you a right to a refund.
Acceptable use
- Do not connect accounts you are not authorised to use or upload data you have no right to process.
- Do not use the service to plan unlawful, deceptive or spam marketing.
- Do not attempt to break, overload or reverse engineer the service, or to access other customers' data.
We may suspend a workspace that breaks these rules, after notice where that is reasonable.
Your data
You keep all rights to the data you bring into the service and to the plans, reports and drafts produced for your workspace. We use your data only to provide the service to you, as described in the privacy policy. You can export reports and delete your workspace at any time.
Automatic actions and guardrails
Automatic budget changes happen only when you enable auto-execute and only within the guardrails you set, such as the maximum shift per channel and the spend cap. You remain responsible for your advertising accounts, your spend and the content you publish. Approve mode is the default.
Availability
We work to keep the service available at all times. Enterprise plans include a 99.9 percent monthly uptime commitment as described in the plan. Planned maintenance is announced in advance where possible.
Liability
Marketing results depend on many factors outside our control, so we do not guarantee any revenue, pipeline or return. To the extent the law allows, our total liability for any claim is limited to the fees you paid for the service in the twelve months before the claim, and we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.
Changes
We may update these terms. If a change materially affects paying customers, we tell them by email at least 30 days before it takes effect, and they may cancel before then.
